These Terms and Conditions (“Terms”) govern your use of the atec Plugins software suite. These Terms apply to all atec plugins—both free and PRO. By installing, activating, or using any atec plugin (free or PRO), you agree to be bound by these Terms.

1. Service Description

atec Plugins is a suite of WordPress plugins designed to extend and optimize WordPress functionality. The suite includes free plugins as well as a PRO package offering additional features, updates, and support during an active license term.

Where a plugin (or part of it) is distributed under an open-source license (e.g., GPL), that license governs the code itself. These Terms govern your access to updates, support, paid features/services, and any related non-code services provided by the Provider.

2. Eligibility

To use atec Plugins, you must:

• Be at least 18 years old;
• Have administrative rights to install/activate plugins in your WordPress environment;
• Agree to and comply with these Terms.

3. License, Pricing & Refunds

• Free plugins: Provided at no charge.
• PRO package: Paid, licensed on an annual basis. An active license is required to receive PRO features, updates, and support.
• Renewals: A PRO license is valid for one year from purchase. Renewal is required to continue access to updates and support.
• Refunds: All sales are final. Refunds are only issued if required by applicable consumer protection law.
• Taxes/VAT: Prices may include or exclude taxes depending on your location and applicable law.

4. Support & Updates

• Free plugins: Provided without guaranteed support or updates (best-effort, community level only).
• PRO package: Includes updates and email support during the active license term. Response times are not guaranteed but reasonable efforts will be made.

5. External Services & Data Use

Some plugins or features may communicate with external services to function (e.g., license verification, API queries, CDN, anti-spam or analytics endpoints). By enabling and using such features, you consent to those communications and the processing of necessary technical data. For details on personal data handling, please refer to the applicable Privacy Policy.

6. User Responsibilities

You are solely responsible for:

• Installing, configuring, and maintaining the plugins and your WordPress/site environment;
• Creating and maintaining full and frequent backups of your site/data;
• Ensuring compatibility (themes, PHP versions, other plugins, hosting);
• Complying with all applicable laws (including content, privacy, and data protection);
• Using the plugins only for lawful and ethical purposes.

7. No Warranty / Disclaimer

Free plugins: Provided strictly “as is” and “as available”, without any warranty of any kind, express or implied.

PRO package: Provided “as is” and “as available”. The Provider disclaims all express and implied warranties, including (without limitation) warranties of performance, uptime, non-infringement, merchantability, and fitness for a particular purpose.

You install and use atec Plugins at your own risk.

8. Limitation of Liability

Free plugins: To the maximum extent permitted by law, no liability is accepted for any damages of any kind (including direct, indirect, incidental, consequential, special, exemplary, or punitive) arising from use or inability to use the plugins.

PRO package: To the maximum extent permitted by law, the Provider’s total aggregate liability for all claims arising out of or related to the PRO package is limited to the total amount you paid for your PRO license in the 12 months preceding the event giving rise to the claim. In no event shall the Provider be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or lost profits, revenue, data, or business.

9. Termination

• By you: You may stop using the plugins at any time. No refunds will be issued.
• By the Provider: The Provider may suspend or terminate access to PRO features/support if you violate these Terms or use the software unlawfully.
• Effect of termination: Termination ends access to PRO features, updates, and support. Any open-source code already provided remains under its applicable license. Your ongoing use of free plugins is not restricted by termination of PRO access.

10. Intellectual Property

All rights, title, and interest in and to atec Plugins (and related materials, trademarks, branding, and documentation) are owned by the Provider, subject to any third-party/open-source components under their respective licenses. You retain rights to your own website content and data.

11. Changes to Terms

The Provider may update these Terms at any time. Updated Terms will be posted on the website. Your continued use of any atec plugin after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law & Venue

These Terms are governed by the laws of Germany. Exclusive venue for any disputes shall be the courts of Düsseldorf, Germany.
